Safe Shield Consulting’s Privacy Policy

Safe Shield, LLC, DBA Safe Shield Consulting (“Safe Shield”), respects the privacy rights of Users (“Users”) of Safe Shield’s website, www.safeshieldconsulting.com (“Website”). Safe Shield is committed to fair information practices and created this Privacy Policy to ensure that Users can use the Website with confidence, knowing that User’s (“User’s”) privacy is protected.

This Privacy Policy applies to the Safe Shield Website only, and does not apply to any websites of third parties (“Third-Party Websites”), which may have their own data collection, storage and use practices and policies that may differ in any way from our Privacy Policy. Please review the section below concerning Third-Party Websites for additional information.

Each time a User (“User”) uses the Website, the most current version of the Safe Shield Privacy Policy will apply. In accordance with this, Users should check the date of this Privacy Policy each time they visit the Website in order to review any changes that may have occurred since the User’s previous use of the Website. Please review the section below that pertains to Updates and Changes to Privacy Policy.

BY USING THE WEBSITE, USERS REPRESENT AND WARRANT THAT THEY HAVE READ, UNDERSTOOD, AND AGREE TO THE TERMS OF, THIS PRIVACY POLICY. IF A USER DOES NOT UNDERSTAND OR DOES NOT AGREE TO BE BOUND BY THIS PRIVACY POLICY, THE USER MUST LEAVE THE WEBSITE IMMEDIATELY.

1. INFORMATION COLLECTION PRACTICES:

(a) Traffic Data: Like most website operators, Safe Shield automatically gathers information of the sort that browsers automatically make available, including: (i) IP addresses; (ii) domain servers; (iii) types of computers accessing the Website; and (iv) types of Web browsers accessing the Website (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify a User.

(b) Cookies: A “Cookie” is a string of information that a website stores on a computer, and that the computer user’s browser provides to the website each time the computer user submits a query to the website. The purpose of a Cookie is to identify the computer user as a unique user of the Website. Safe Shield uses Cookies to customize a User’s experience on the Website to the User’s interests, to ensure that User’s do not see the same advertisements or informational messages repeatedly, and to store User’s password so that the User does not have to re-enter it each time they visit the Website. (c) Personal Information: In order for a User to use certain Services, User will be asked to provide Safe Shield with certain information that does personally identify the User (“Personal Information”). Personal Information includes, without limitation: (1) “Contact Data” (such as User’s name, phone number, fax number, mailing address and e-mail address); (2) “Financial Data” (Safe Shield does not store or otherwise retain financial or credit card information); (3) “Business Data” (such as the name of User’s corporation or limited liability company (LLC), the name and address of User’s corporation or LLC’s registered agent, the name and address of the directors and officers of User’s corporation or members, managers, or governors of User’s LLC, and the name of User’s trademark and the goods and/or services provided under such trademark); and (4) Demographic Data” (such as User’s gender and zip code). In each case, User will be asked to provide Personal Information; the Website will not gather it surreptitiously. Safe Shield may supplement the Personal Information Users provide with additional Personal Information gathered from public sources or from third-parties (e.g., consumer reporting agencies) who may lawfully provide such information to Safe Shield. Users are under no obligation to provide Personal Information, with the caveat that User’s refusal to do so may prevent User from using certain Services.

2. INFORMATION USE AND DISCLOSURE PRACTICES:

(a) Traffic Data and Information Gathered Using Cookies: Safe Shield analyzes Traffic Data and information gathered using Cookies to help Safe Shield better understand who is using the Website and how they are using it. By identifying patterns and trends in usage, Safe Shield is able to better design the Website to improve User experience, and to supply Users more relevant and interesting content and advertisements. From time to time, Safe Shield may release Traffic Data and information gathered using Cookies in the aggregate, such as by publishing a report on trends in the usage of the Website. Safe Shield does not attempt to link information gathered using Cookies to Personal Information.

(b) Personal Information:

(i) Generally. Safe Shield uses a User’s Contact Data to send Users information about Safe Shield and Safe Shield’s Services (“Services”), which are detailed in our Terms and Conditions, and to contact Users when necessary in connection with the Services. Safe Shield uses Financial Data to verify User’s qualifications for certain Services and, when necessary, to bill the User. Safe Shield uses User’s Business Information to file corporate/company documents. Safe Shield uses User’s Demographic Data to customize and tailor User’s experience on the Website. As with Traffic Data and information gathered using Cookies, from time to time Safe Shield may release Demographic Data in the aggregate, such as by publishing a report on trends in the usage of the Website.

(ii) Disclosure Practices. Except under the following circumstances, Safe Shield will keep User’s Personal Information private, and will not share it with third parties.

• Disclosure to Governmental Agencies. Safe Shield provides, among other services, corporate filing services (collectively, “Corporate Services”), which require the filing of official documents with certain federal, state or county agencies (e.g. state offices of the secretary of the state) (collectively, “Governmental Agencies”). In order to prepare and file such official documents, certain Personal Information provided by Users must be disclosed to the appropriate Governmental Agency. If User’s have requested Corporate Services, User hereby acknowledges and agrees that Safe Shield will disclose certain User Personal Information to the appropriate Governmental Agency. User further acknowledges and understands that information received by Governmental Agencies may become public record and subject to inspection and copying by the public. SAFE SHIELD IS NOT RESPONSIBLE AND DOES HEREBY DISCLAIM ALL RESPONSIBILITY AND LIABILITY FOR THE DISCLOSURE, SUBSEQUENT USE AND CONTINUED PROTECTION OF YOUR PERSONAL INFORMATION PROVIDED TO, VIEWED, OR DOWNLOADED BY GOVERNMENTAL AGENCIES.

• Disclosure in Connection with Services. Safe Shield discloses Personal Information to those who help it provide services, including those who perform technical, administrative and data processing tasks such as hosting, billing, fulfillment, and data storage and security.

• By Law or to Protect Rights. Safe Shield discloses Personal Information when required to do so by law, or in response to a subpoena or court order, or when Safe Shield believes in its sole discretion that disclosure is reasonably necessary to protect the property or rights of Safe Shield, third parties or the public at large.

• Business Transfers; Bankruptcy. Safe Shield reserves the right to transfer all Personal Information in its possession to a successor organization in the event of a merger, acquisition, or bankruptcy or other sale of all or a portion of Safe Shield’s assets. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred Personal Information will be subject to this Privacy Policy, or to a new privacy policy if Users are given notice of that new privacy policy and an opportunity to affirmatively opt-out of it. Personal Information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by Safe Shield’s successor organization.

• Unpaid Accounts. If a User fails to pay any balance owed in consideration of services, Safe Shield may, as permitted by law, report User’s Personal Information, including without limitation the User’s unpaid balance, to consumer credit reporting services, collection agencies and others.

3. SECURITY OF PERSONAL INFORMATION:

Safe Shield has invested significant time and resources into protecting the Personal Information of our Users. We have implemented, and maintain reasonable security procedures and practices to protect against the unauthorized access, use, modification, destruction or disclosure of User’s Personal Information.

4. LOST OR STOLEN INFORMATION:

Users must promptly notify Safe Shield if a User’s user name or password is lost, stolen or used without permission. In such an event, we will remove that user name or password from User’s account and update our records accordingly.

5. CHILDREN’S PRIVACY:

Safe Shield does not solicit or knowingly collect personally identifiable information from children under the age of 13. In the event that Safe Shield obtains actual knowledge that it has inadvertently collected personally identifiable information from a child under the age of 13, Safe Shield will immediately delete, or otherwise remove such information from its database. Because Safe Shield does not collect personally identifiable information from children under the age of 13, we have no such information to use or disclose to third parties. Safe Shield has designed this Privacy Policy in order to meet, and comply with all requirements of the Children’s Online Privacy Protection Act (COPPA).

6. CONSENT TO RECEIVE EMAIL FROM SAFE SHIELD:

By registering with the Website, Users thereby consent to receive periodic email communications regarding the Services offered by Safe Shield. As part of registration, Users may also choose to receive email communications regarding promotions and other special offers (collectively, “Special Offers”). Users will have the option to “opt-out” from receiving Special Offers at any time by (a) following the unsubscribe instructions contained in each Special Offer; or (b) sending an email to info@safeshieldconsulting.com requesting that we remove the User’s e-mail address from our Special Offers e-mail list.

7. UPDATE PERSONAL INFORMATION:

Safe Shield wants User’s Personal Information to be complete and accurate. As stated in the [Website Terms of Use], by using the Website, Users represent and warrant that all information Users provide on any registration form or otherwise in connection with User’s use of the Website and Services will be complete and accurate. Users should contact Safe Shield to confirm the completeness and accuracy of, or make changes to, User’s Personal Information. If a User fails to notify Safe Shield of any changes to their Personal Information, Safe Shield shall not be responsible for the display of any inaccurate information.

8. THIRD-PARTY WEBSITES:

Safe Shield does not own, nor does it control any Third-Party Websites. Accordingly, Third-Party Websites are not obligated to comply with this Privacy Policy except with respect to Personal Information that is provided directly to them by Safe Shield. Before visiting or providing Personal Information to a Third-Party Website, Users should become informed of the privacy policies and practices (if any) of that Third-Party Website, and should take any and all necessary steps to, in User’s discretion, protect User’s privacy.

9. PROMOTIONS:

Safe Shield may periodically conduct contests, giveaways and other promotions (collectively, “Promotions”). Any information submitted in connection with Promotions will be treated in accordance with this Privacy Policy.

10. RESEARCH AND SURVEYS:

From time to time, Safe Shield may conduct research or ask Users to participate in surveys, which are designed to help Safe Shield improve the Website and the Services we provide. Any Personal Information provided to Safe Shield in connection with any research or survey will be used only in relation to that survey, and will be disclosed to third parties not bound by this Privacy Policy only in aggregated form.

11. UPDATES AND CHANGES TO PRIVACY POLICY:

Although most changes are likely to be minor, Safe Shield does reserve the right, at any time and without notice, to add to, update, change or modify this Privacy Policy, simply by posting such update, change or modification on this page. In the event that Safe Shield does add to, update, change or modify this Privacy Policy, any such addition, update, change or modification will become effective immediately upon posting on the Website. Each time a User uses the Website, the most current version of this Privacy Policy will be applicable. In accordance with this, each time a User returns to use the Website that User should check the date of this Privacy Policy (as it appears at the end) and review any changes since the last time the User used the Website. Unless a User provides Safe Shield with User’s express consent, any revised Privacy Policy will apply only to information collected after the effective date of such revised Privacy Policy, and not to information collected under any earlier Privacy Policy.
